I am bumping this old thread since I might have missed something in this discussion.
Some advantages of staying on H1 stated earlier were:
For me:
(2) is invalid (Already married, wife on independent visa)
(3) don't know (Heard it's more flexible now, so willing to take this risk)
(4) USICS started issuing 2 year EAD, so the difference is only 1 year additional extension with H1 (Not a problem for me personally)
(5) is invalid (Most of us renew EADs even if we dont use them)
which brings me to (1). How does having H1 give peace of mind? Hypothetically, if 485 is denied and H1 was extended beyond 6 years based on a pending AOS, is it still valid during MTR/Appeal? If it is, since EAD doesn't provide this privelege, I think this is the only reason why people should stay on H1?

NO point#1 is not true. in fact it is biggest misconception - I remember reading some where that if you have consumed all your 6 years on H1, your extension of H1B beyond 6 years is only based on pending AOS. So in this case, if your 485 is rejected, also your H1B. If you continue to work on H1B even after this, it is illegal.
(This is what I believe & I may be wrong. I am not lawyer, this is not legal advice & check with your attorney first before deciding anything)

Whatever the hide and seek game be, we the actual filers will never suffer.
Adding to that there is an independent case already filed in the US courts, so we are on a stronger wicket.
Again, USCIS cannot keep our application in cold storage without extending us the benefits of pending I-485 application.
We will get the good news soon.

OK, coming to the point, how did you open 2nd SR within a week. Did you get any response for the 1st SR or 2nd SR at all? If so, what was it?
Did the senator's contact help you at all?
What did u ask when you went for the infopass?
What do you think, that could have triggered CPO? May be your rep at the infopass sent an email to NSC?

I know a lot of people using pre approved labor certs waiting for GC. What happens to them? I think this rule will affect only those who are trying to do Labor substitution in future.
* Since this is a final rule, upon approval by OMB, the elimination of substitution and 45-day validity of certified labor certification will be triggered. Take this message as a very special alert! This rule will not only eliminate substitutition on the OMB approval and release in the Federal Register but also kill the certified labor certification unless it is used within 45 days from the date of certification! I am in the same boat. I had interview on Dec 17th at 10:30 AM and have not yet received my passport. The lady at the chennai consulate said that they are still waiting on the PIMS verification. I am getting very anxious as I have return tickets for Jan 04.

Folks I have an update on my case.
We filed for Motion to reopen on which were receipted on March 27th, 2009. I wrote to Congressman, Senators and also Ombudsman. Today my congressman's office got an update that our MTRs were approved on April 30th and our 485s got reopened and they have sent letters to that effect.
What a relief. It was a stressful 6 week ordeal. Thanks to IV and its members for the help and support.

Took Atlas America due to their "acute onset of pre-existing clause". Mom got pneumonia 3 weeks after coming to US in April last year. They declined to cover hospital bills saying it is a pre-existing condition. Doctor's opinion was she acquired it due to cold weather and highly improbable for someone to have it not get sick for 3-4weeks. Insurance did not care. Still paying the bills.

I would keep it simple. H1 is a very solid backup in current market. I just don't want to close any options.
I respect your opinion. I myself a layman, and like your signature says gathered or rather trying to gather information from various online forums, chats and discussions.

I would understand if walking_dude was asking me to fly to Michigan and stand with a placard in front of the radio station (which I MIGHT do btw), but sending an email is a five-minute effort, which everyone can do sitting at their home/office/library.
I don't think we will dilute any other effort through doing this.

Just wondering why USCIS is neither accepting nor rejecting the July 2nd application? How long can thy hold applications like this? Can they leverage this in their favour in the class action lawsuit? Is this procrastination deliberate , considering its legal implications?
Both the AILA and USCIS are playing hide and seek. Who ever shows up first, basically looses. So both are still hiding and we are loosing our sleep. :)
