Based on your response, my understanding is that so long as I am with my current employer, travel on H1 /H4 is fine. When she gets back, I can consider using my EAD to switch jobs.
You mentioned "if you or your wife don't want to use EAD in the near future..." - to your knowledge, will there be a problem if I use my EAD during her trip to India?

Hi,
I am currently on h1b visa without a project from past 1 year in US and my employer asked me to convert to L2 visa dependent on my husband who is on L1 visa . I do not have any paystubs for my stamping. If I go to canada consulate for stamping, what is the success rate for my visa being approved?Will I be able to come back to US without any issues.Also, can you suggest me to which consulate should I go for my stamping?Please help!

I am planning to to go to India next year my visa expired in 2004,since my AP is approved i am planning to go for H1B visa stamping in India if in case the H1B visa is rejected can we come back to US using AP.

Members are fearful of even giving the correct email ids to us. Thousands of our emails bounced this week when we sent an email to our members. We want everybody to roll up their sleeves and participate in meet the lawmakers drive.

I would like to know that can I apply for EAD extension for me and my wife since my I-140 application was denined last year. We have already appeal for decision on I-140 application to AAO office. I am intend to get my wife's EAD extended by year end.

Is your 485 also denied? Most of the times when ever 140 is denied then the underlying 485 also gets denied and if that is the case then you cannot apply or extend for EAD or AP until your appeal is pending with AAO. I may be wrong so consult an attorney.

I actually went for stamping in my 4th year, that's after extending my H1 after the first 3 years. They didn't ask any questions. I'm not from India though so I don't know whether its different.

I'm a green card holder (singapore citizen) who got married while being a US PR. I wish to apply for my wife (singapore citizen) a green card.
How long is the typical wait?
See visa bulletin. Your case is Family Based (FB) 2A. Currently, it is at 01APR06 (i.e., the applications that USCIS received before 04/01/2006 are eligible to be approved). You need to study how quickly the dates move by going through VISA bulletins in the last 3-4 years, but my guess would be about 5 years.
Visa Bulletin for March 2010 (http://travel.state.gov/visa/frvi/bulletin/bulletin_4659.html)
while applying, is it true that my wife can't enter the US?
AFAIK, not on the basis of her GC application, but if she gets another (dual-intent) VISA, say H1B, then she can enter US.
I kind of know the answers but would like to confirm with this forum. I know the situation can be pretty bleak.

I was in EB2 with 485 pending. I applied in EB1 and had 140 approved. I asked USCIS to approve pending 485 based on EB1 140. My GC was approved but wife's petition, pending at another field office, was denied and the officer said there is nothing like linking pending 485!
Can we use the pearson memo to justify our case? The memo says both the petition dates should have current priority dates?!? Is that correct? Are there any other memos we can use to make our case? My wife cannot file another 485 as she does not have a non immigrant status.

Photoshop might have a filter that could do this, although I'm not sure off the top of my head. I'd go with the Flash version myself, it's quick, easy and you can cut and paste the result into another package without any hassle.

My wife had concived for 3 days in June. During immigration medical exams Doctor gave her MMR shots and stated don't get pregnant for another 3 months.
After 15 days, We came to know that she is pregnant.
last week my wife had miscarriage after 18 weeks of pregnancy. Not sure it's because of MMR or something else.
can't comment on the connection between MMR and MC but whatever may be the reason a MC is always very painful ... we also had gone thru the same agony and pain last year though the reason for MC was unrelated than yours ... this year we are blessed with a baby boy .... do follow the OBGY's advice and if suggested do the D&C (personal opinion offcourse but it was a great help for us) ..
will wait for the good news from your guy's side in next couple of month's time ...

You should get approved soon , its just matter of time . if possible take a infopass and find out where your application is .

Friend of mine, asked me the below question, any one can Help?
I got my H1-B visa stamped in the month of Feb 2007 from US consulate in chennai. I have not yet travelled on that visa, so I am wondering whether the same visa is still valid, as someone told me that if you don't travel on a visa for 6 months after stamping, it gets expired.
