    I agree with you 100%. We are so much divided community, lets not create another factor to divide this community further in paid and non-paid members.

    Let us all blame IV core for not getting our greencard and having a crappy visa bulletin this month. :)
    I contributed $5 in the high five campaign and I still do not have my labor cleared. I want to blame IV for that too. :)

    where is this 120k EB2I and C coming up from, those who haven't filed 485 yet? So you are expecting another july 2007 making all EB2 Current.

    Here is a brief calculation of EB2 Demand till date (Today's Date)
    The total demand till date is ~ 120K which is
    Demand up to Aug 2007 = 45K
    Sep 2007 to Dec 2008 = 16 * 2.5K Perm Month = 40K
    Jan 2009 to Oct 2010 = 22 * 1.5K per month = 33K
    New PD porting after Aug 2007 (Current Eb3 Inventory is 60K till Aug 2007) = 10K
    Total 45 + 40 + 33 + 10 = 128K. This may be inflated but it is atleast 120K.

    By giving these numbers I don’t mean to scare anybody but it’s better to have a tryst with true reality rather than be ignorant. It is better to have an understanding of the backlog rather than feeling bad VB after VB, nothing will change soon because the backlog is so huge.

    If you look at the numbers it is very unlikely that EB2 will literally become current any time soon, the end of the pre-adjudicated numbers is just a tipping point and when this happens anything could happen 1) Make dates current (I personally welcome that atleast everybody gets a chance to file for I485) 2) Keep accepting applications in a controlled manner so as to approve in quarter or year. 3) Grant spillover to EB3 ROW (EB3 ROW backlog is so huge like EB2 - I in the same range 100-120K that the spillover will disappear in no time, also note that EB3 ROW incremental demand is much higher than EB2 ROW). If you look at EB2 ROW for last year they were current for the whole year but approvals came from 2007. Its the agencies discretion really how they want to control and regulate the demand and honor the INA and the distribution rules. I believe that what may happen when EB2-I/C preadjudicated numbers get exhausted is Option # 2) Keep accepting applications in a controlled manner so as to approve in quarter or year because this is what happened for EB2 ROW; again this is my personal guess / assumption. Also those who have not been able to file for I485 cannot be kept in a endless denial with the preadjudicated numbers exhausted I think the chance will come for EB2 friends.

    The spillover is a happening of the present time when the economy is bad, the moment this changes everything will disappear and there will be no difference between EB2 and EB3 if you belong to a retrogressed country we will all be at 3K Per annum and EB5 contribution if any will be consumed by PD porting which will increase manifold as EB3-I folks waiting for 10 years is simply unacceptable, currently there a 60K folks here just till 2007. I strongly favor porting waiting for 10 years is unacceptable. Also being without EAD / AP is very hard, great that we have a IV campaign initiated for this the efforts in this direction are laudable. Actually as Pappu, Admin2 and others have been saying EB3-EB2 even though may be relevant now is actually meaningless this is relevant only in this temporary phase of time fighting on these lines will not help to attain any objective rather it will kill chances of EB3 friends with later PD to port. The biggest issue is the per country limits which equate talent pools like India and China and give them the same cap as countries which have 1/1000th population, if they cannot be eliminated atleast should be proportionate to population for larger countries and be at 7% for the smaller ones. PS - I have nothing personal against ROW friends.

    Incorrect. You have to submit proof of employment. Basically a letter from employer. If you are unemployed that that will raise a red flag and you cannot renew your EAD anyways. So current and future employment letter is a must for getting EAD. Sometimes they even ask you for salary slips if they suspect your employment. In this proposed amendment the employer also has an obligation to record layoffs and inform government. That makes it very tough for EAD guys to renew their EADs. Even if you are not working for the same company that filed your EAD, USCIS record can show there were layoffs and your applications will be in trouble. Expect lot of RFE and denials. Remember AC21 denials last year?

    what the heck r u talking. i just renewed my EAD myself, no employment letter, no pay slip, no crap. Don't blabber if you dont know the details.

    There is clear guidance in that H1-B petitioner seeking extension does not have to be the same employer that had filed (and approved) the I-140. Once you have an approved 140, anyone can extend your H1 for 3 years

    I checked with somebody who has hired Rajiv Khanna as his lawyer. He said that those who had filed in July are fine and there is no need to re-file it.

    I am still waiting to hear from my lawyer though.

    EB2 I/C won't be current in the next 4-5 Years, the EB2 I/C demand till date (Today’s Date) is in the 100K - 120K Range. The EB2I/C demand till Jul/Aug 2007 is easily in the 40-45K Range so it will require a very over optimistic scenario to clear by Sep 2011. EB3 ROW will reach end of 2006 by FY 2011. So there is a very long way to go. All the movement is under many assumptions most important being the economy and unemployment, anytime this changes all spillover will collapse and there will really be no difference between EB2 I/C and EB3 I/C.

    I just called my congressman office and explained the sitatuion. The aide asked me to call the legislative aide in the Capitol Hill to discuss about changes. She said the congressman understands the importance however the political fraternity is currently trying to resolve the financial crisis and Immigration Reform is the last thing on their mind.

    When I asked her honest opinion about visa numbers being released she did suggest that if you can join an immigration group with a good lobbying firm it can be a possibility that Congress can approve a 'piece-meal' bill releasing visa numbers by moving numbers from unused categories and/or unused from past years.

    Again the emphasis was "Group focusing on Legal Immigration with a good Lobbying Firm".

    Administrators, Senior Members and All:

    I think it is the time to plan something big as 'Saburi' mentioned and bring our issues to their attention.

    Please count me in for any rallies / organizing help.

    All IV members please weigh in your thoughts.

    I have listened to a couple of speaches by Bernake in NPR. Basically that guy is completely in the blank on how to handle the economy. He simply says, we are in this mess, because the lendors were very lenient. Fed measures such as interest rate cut and pumping money into the banking system is causing the dollar to fall thus further weakening the economy.

    I say, we all write to Bernake that some 10, 000 immigrants will buy homes if we all get a GC. 100, 000 may or may not buy a home, but let us just polish the numbers a little bit. 10,000 * 300,000 (average home price) = 1 million billion dollars :D. Actually the total figure is 3 billion $$; enough to give a massive jolt to the sagging economy. I think we should also write to Wall Street journal and all major news paper organizations about this.

    In America, people gets recognized when they offers a solution for a problem faced by the country. Whiners are (who write to Bush or Senators) do not get noticed nor are respected.
