Hi
My wife appeared for Visa interview on 6th and yet to receive the passport. we booked tickets for this weekend and seems we have to reschedule. I sent a mail to NIV and no response as of now.This is of concern. can anyone tell me about the normal turnaround time for H4 Visas these days?

When I was asked to resubmit documents after the interview (via drop box), the consulate said they will need 6-8 working days from the date of receipt of the latter. They indeed took only 7 working days.
Also, I believe they must already have done PIMS verification in my case since they asked for additional info 16 days after the interview. So in total it took them 29 days ( incl weekends)
In your case, it doesnt seem they got enough time to do PIMS. It is hard to
estimate the delays.

I have started taking printouts of the instructions and handing it to people - hoping that will increase the probability of them calling.
Great idea. Thanks for doing this. As we know from our admin fix campaign, our own members sometimes do it as soon as you hand out a hard-copy!
Also folks please don't feel shy to speak to these reps or their aides. On the other hand, please know that they respect you a lot for taking the time to call them and let them know what you feel about an issue.

I voted for both questions.
BTW Sen. McCain is now front runner in GOP for presidential candidate. Even though he backed out of immigration reform, I consider him our friend and also a person of integrity. I am glad to see him emerge as front runner. On the other hand Tom Tancredo figured nowhere, even when immigration was still hot issue. That should be enough for our friends in NumbersUSA & ALIPAC to see where they stand in terms of public support for their issues.

You guys are not getting it. No (in like None, Nada, zilch etc.) insurance covers pre-existing condition for visitors. If a complication arises, and you had to use the insurance, the question will be if it is a pre-existing condition or something that came up after coming here. Even if the condition comes up where an incident is not related to pre-existing condition but aggravated due to pre-existing condition, insurance will cover minimal claim amount. The odds are rigged up against you no matter what. Put yourself in the insurance companies shoes. The less you pay the more you make so you always try to deny the claim.
Saying this, you are betteroff buying a American Insurance as hospitals over here see it as something they can count on for being paid back (though law says they have to give the topmost care irrespective of the patients ability to repay). Indian insurance is useless and will be looked down by medical personnel (some of the private pracitioners won't even accept it). Just buy some American Insurance and pray you don't have to use it.

There is no reason for AOS interview. So many people were have been called for interview.. My I-485 is Employment based... I don't have any arrest or anything else on my records... My BC was cleared after 2007 filings so I am not sure why they will delay it second time...

ICICI Bank has started a 'Express Pay' service in which your monety gets transferred in 1-2 day but they charge 5 $ for that.
I think you might have selected that option while transferring. Thats the first option ...
My experience is even their 'Express Pay' service is a rip off unless you have experienced otherwise first hand !

Hi I've been a NC victim for almost 3 years. I have heard all kinds of speculations on the real reason behind USCIS/FBI decision,like the amount of the tax you pay, your political view, your education level,etc. all influence the result. Could that be true or it's just purely a bureaucratic backlog? Something interesting to think about I guess.
Oh, come on. I think situation is much more simple than that. I wonder if FBI really got ONE bad guy among H1b poor souls. FBI perfectly knows that it's just stupid to suspect a person who lived on same place for years, personally went to fingerprinting, submitted all kinda information about himself and humbly waiting for GC in being some "threat".
Because of that FBI considers us "low priority", simply - they don't care about us. But the law requires them to check us, so those who got "no match" automatically pass without any human intervention. But those who by some reason "matched" are awaiting for some FBI dude to push couple of buttons on his computer. But since FBI dude will be first considering more important things to do, those couple of "button presses" might take couple of years.
This is how I see it. If that's true, then ironically if some of H1bs would be involved in drug trafficking, prostitution or would really posses any threat - namechecks would be going really quick.

that would most certainly be the politically correct thing to say. Unfortunately, most people don't come with an OFF/ON switch.. Yesterday, I was a citizen of X - country , I support X whole heatedly, today, I am a citizen of Z - country, so I will support Z whole heatedly - more so because the whole naturalization process is not an OFF/ON switch either.

As I see it, the only persons benefited are the ones having the priority dates in ancient times. I think we really should not mind letting them have their GC's, being our seniors.
Yes, later year porters might end up having to wait. It's all in the game, fortunately or unfortunately. One thing is for sure, we as a whole, have an uphill battle
If it really comes to matter, I think it should be easy for an EB2 to port to EB3 if the dates are current for him in the different category. So if I were EB2 today, I wouldn't be so apprehensive :)

In ac21 law; it doesn't say anything about the scenario if 140 is revoked by employer. It is totally silent to it.

AC21 is not a law, just a guidance. Assume an immigration case goes to court hearing, the judge would completely ignore AC21 guidelines. Any employment per AC21 will be considered unlawful in this case. The probability of a case going to court is not very common though.
The above is just FYI.. You can google for more info.
Don't let lack of knowledge and fear of oppression take over your "thought process".

The issue with all this is that we are not raising our voices loud enough about this training issue or procedural issue ant it is always the individual who deals with the case at individual level by filing MTR.
The entire beurocracy and red tape that one has to deal with in such instances is an issue. People have to file MTR - pay legal fee, involve lawmakers if they don't get response soon, write to Ombudsman .....
So lets stop all "speculation", "fear mongering", "own intrerpretations" and work towards helping ourselves

I never got any LUDs but got a denial on my 485 after going through the AC21/NOID stuff way back in August, 2008.
There could be some background processing going on.
Is there are pattern to these LUDs?
I am in a situation that the company where I am working is offering a permanent position and my employer is also willing to support me. But I am afraid of doing AC21 after reading about the pitfalls of AC21. Any suggestions??

Was the H1B through a body shopper? I"ve heard of reopening all old cases of a company if they find a dubious H1B sponsorship, or if a company gets blacklisted.
If your company is solid and your case is genuine... you probably have nothing to worry about.
