There was no provision for validating visas in the US, at least not in our Brownback amendment. I am not aware of that being a rider on any other amendment -- but I wouldnt' rule it out

We will have to do a post-final-bill-with-amendments analysis.

Please hold on till that becomes available.

    Thanks,
    Berkeleybee

    It was in Cornyn ammendment.

If you have the ead card, the file #/card# will tell you which center was your EAD fiiled. To get an approximate date using the online case status search for the file number in the approximate range as yours. For Eg. if you card # is EAC 07 043 52343 - then the center is Vermont, Filed in Fisical year 07 ( Oct -06 - Sep 07) 043 is the 43rd working day in FY07 and 52343 is the case number.

    Hope this helps.

I am filing for my EAD renewal and had a quick question...I have an EAD card from when I was in college and did my OPT. The problem though is that I do not have some of the details that they ask for while filing EAD renewal, such as what Center was it processed at & what was the application date.

I have already called USCIS & they cant pull up what center my EAD was filed at or the date it was filed. Can anyone suggest what I should do in this situation? What do I put in the form? Does anyone have similar experiences?

What is the purpose of this poll? Why start from 2005 (and not from 2001) ?

trueguy has a poll started for period from 2001 to 2004 and I have started this for 2005-2008.

The limitation is that we can have maximum of 10 entries in a polling!!!

Not sure if the core have more options.

Thanks a lot for all your quick responses. I will try to get this done soon. When you say be prepared for lot of questions, do you mean questions like "Why did you come here for visa stamp instead of going back to home country"

    Yes.....HIb is correct....
As she is free, she is planning to finish her studies in 1.5years....
as there is a requirement for 1year F1 status to use OPT, we have to take a decision now...
Anyways the process itself will take 3months......as per current times.

Miracle or no miracle will be the point now???

We're in a unique situation. My wife and I married in India and didn't register our marriage; we're now citizens of country X. To get our marriage (and birth) certificate, we went to the local Indian consulate, which provides these services. But we were told that, since we're no longer Indian citizens, we should go to X's consulate. Is there a way we can get the certificates? How about registering our marriage in the US?

For BC, our parents sent us the affidavits and we were thinking to get a certificate of BC's non-availability through mymanindia.com. Is there a quicker solution?

He did ask me who filed for the GC so he knew mine was EB case.
    Elaine,
Is there any document on USCIS website that clearly states that EB AP holder's can visit outside US and return without need of emergency?
    thanks,

If you see the instruction of form I-131, it clearly says AP is an exdraodinary measure and should be sparingly used, for emergency purpose (page 1). AP can not be used to by pass the visa or visa issuance process. It clearly says that if AP is based on pending I-485, then the travel should be for family emergency and bonafide business purpose (page 3).

As because, USCIS/CBP is flexible for AP admission it does not mean that the rules are flexible. If the CBP agents at POE wants to flex their muscles they can deny the admission of AP holder, if they found the travel was not an emergency or a bonafide bussiness travel.

I am a dentist in state of CA,and filed for EB2 green card.In April 2006 applied for my PERM from MD Dental, a dental group with 5 offices and about 30 employs and owned by 2 partners. Also in April 2006 they applied for my H1b visa.Further PERM and H1b both were approved and in may 2006 I filed for I-140 from the same company.I-140 had a RFE but was approved in Feb 2007.Meanwhile in Oct 2006 both partners had a is understanding and they split the company into 2 companies with one partner getting 2 offices and the other partner getting 3 offices.Originally my perm was filed from the MD dental Van-Nuys office, which was given to partner A who then told me to file for a new H1b as tax ID number for the employer has changed but my job location would not change. I filed for a new H1 visa from partner A which was also approved and started to work for him till Feb 2007.

In feb 2007 I found a new job again as a dentist with a different company and moved to that company.I am still in good contact with both partner A and partner B of the old company.

My question is if I could file for I485 from MD dental which is already split with
approved I140, or I could file it from partner A or partner B`s new company showing either of them as succesor of interest. Also can I invoke AC21 in 6 months and move to my current employer.
    Please advice.

May be you need to amend I-140. Please consult a good attorney/lawyer.

    Not a legal advice.

    Thank you for your reply.

My perm was approved on August 27th 2007. The EB3 became current upto August 17th 2007. Besides, my lawyer got late in preparing the paper work for the PERM etc. and that's why we just missed.

With regard to my situation, does this meanI have to file for my PERM and I-140 all over again?

Also, is it possible under an H-1 for an employer to cut down wages and reduce work hours?

Thank you for your time once again.

    Sincerely

    Omi

Bank denied a consumer loan ,after approval due to immigration status specifically they said no loan unless you are a citizen. i am a permanent resident , leaving in the US for over 15 years. Applying for naturalization this year. Also the same bank had approved a consumer loan 2 years ago and now they say "oh we made a mistake then". Case or no case? I think I have been discriminated against.

That is not true. It CAN count... according to PERM guidelines (from murthy.com):

"On-the-job experience with same employer is allowed for positions that are not "substantially comparable," meaning more then 50%, different from the original employment position."

So if you are a Software Engineer and get promoted to Sr. Software Engineer or Product Manager then as long as you can prove that your job duties are 50%+ different than the old position, you can use that experience provided it helps you meet job requirements for the senior level position.

    Also see this:

    http://www.simmonsungar.com/rirchecklist.html

    "Experience Gained on the Job

PERM did not eliminate the ability of the foreign national beneficiary of the labor certification to qualify using experience gained with the same employer as long as the prior job was not substantially comparable to the labor certification position. A job will be considered substantially comparable if it requires performance of the same job duties more than 50 percent of the time.

Apparently, experience gained with an overseas parent company, U.S. affiliate, or predecessor company will not be considered experience gained with the same employer. This is based on the definition of employer as an entity with a particular Federal Employer Identification Number (FEIN). This means that experience gained with an overseas parent, affiliate, etc. may now be used to satisfy the experience component of a PERM labor certification application."

    Interesting! Thanks for the correction

I am writing the second of a multi-part series of posts on how to bring family relatives to the United States permanently. The first post I wrote provided general information on bringing family relatives to the United States. (See my post, "Can I petition for my relative to immigrate to the United States?" (http://www.californiaimmigrationlawyerblog.com/2009/05/can_i_petition_for_my_relative.html)) This post will focus on how to petition for your brother or sister to come to the United States permanently.

In order to petition for your brother or sister you must file Form I-130, Petition for Alien Relative (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=c67c7f9ded54d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1 RCRD) with United States and Citizenship Services ("USCIS") along with proof that you are a United States Citizen and that you are related to your brother or sister. I will discuss the steps you must take in more detail below.

    Obtain Form I-130 (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=c67c7f9ded54d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1 RCRD)

You may obtain Form I-130 (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=c67c7f9ded54d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1 RCRD), by clicking on the link in this post. At the same time that you obtain the form, you should also print out the instructions to the form. They are more detailed than the instructions I will provide in this post and provide the mailing address to where you will need to send the form.

    Proof of U.S. Citizenship

You may prove that you are a U.S. citizen by sending one of the following documents to USCIS with your petition:

A copy of your birth certificate (if you were born in the United States) issued by a civil registrar, vital statistics office, or other civil authority.

A copy of your naturalization certificate or certificate of citizenship issued by USCIS or the former INS.

A copy of your Form FS-240, Report of Birth Abroad of a Citizen of the United States, issued by a U.S. embassy or consulate.

A copy of your unexpired U.S. passport. OR

An original letter from a U.S. consular officer verifying that you are a U.S. citizen with a valid passport.

Here is the mail from AILA,
    September 25, 2006

    Dear Immigration Advocates-

Your help is STILL needed TODAY! Senate Appropriators will meet late THIS AFTERNOON to decide if enforcement-only bills will be included in the Department of Homeland Security's appropriations package. Urge your Senators to oppose efforts to attach anti-immigration measures to this must-pass bill. Call or email your Senators TODAY - encourage them to weigh-in with Senate Appropriators about this urgent matter.

You can find general information about the three bills below and a section-by-section analysis of each one on InfoNet.

Email your Senators through Contact Congress on AILA's website. We've already created a sample letter for you to send. All you need to do is enter your zip code, hit send, and your voice will be heard in Congress.

Call your Senators, you can find their telephone numbers in our Congressional Directory and you can use these talking points to help you when you call:

Congress should stop playing politics with immigration and pass comprehensive immigration reform. These enforcement-only bills will do nothing to enhance border security and will not move us one inch closer to fixing our broken immigration system.

Attaching these bills to DHS appropriations circumvents the legislative process on an issue of critical national importance; it undermines the intense and unflagging efforts of the Senate to solve this crisis; and it rewards the House for spending the summer attacking the Senate while abdicating its responsibility to the American people.

Senators should forcefully oppose this effort by the House to nullify the Senate's bi-partison solution. If the Senate acquiesces on these provisions, the House will only be emboldened and will never return to debate comprehensive reform. This will not be "enforcement-first", it will be "enforcement-only."

For laws to work, they must be realistic and fair. Our current immigration laws are neither: proposals like these that ignore the reality that immigrants come here to work and to be with their families are destined to fail.

Giving the government unchecked powers to punish immigrants, and making local police chase after immigrants, will only drive undocumented immigrants further underground. It will not fix the problem; it will make matters worse.

We called you to action last week to alert you to an underhanded political strategy from immigration restrictionists to attach three enforcement-only bills to the DHS appropriations bill, a bill that must pass this year. You and your colleagues sent close to 2,000 letters to Congress, but we'll need more letters and phone calls in order to ensure that Senate Appropriators exclude these measures from the bill.

Leaders of the U.S. House of Representatives are working behind closed doors and using procedural mechanisms to attach enforcement-only provisions contained in three bills (H.R. 6094, H.R. 6095, and H.R. 4830) to the Department of Homeland Security appropriations bill, a piece of legislation that must pass this year. Although House leaders label these bills "border security" legislation, they are in fact harsh enforcement measures lifted from Rep. Sensenbrenner's H.R. 4437 that endanger due process rights and do little to make our borders more secure. You can find general information about the three bills below and a section-by-section analysis of each one on InfoNet.

If these provisions are attached to the must-pass DHS bill, it will be nearly impossible to defeat them. Our best defense against this backdoor strategy is to put pressure on each U.S. Senator and encourage them to oppose any attempt to attach, or further these three enforcement-only bills. We're working hard in Washington to derail these political machinations, but we can't do it alone. We need your help. Please email or call both of your Senators today.

Over the summer House leadership used dozens of faux hearings to stage public displays of aversion to immigration reform. While they kept the media busy and their restrictionist base roiled, they failed to change the minds of the majority of Americans who support a comprehensive solution to our broken immigration system. Nor did they succeed in backing down the U.S. Senators who supported S. 2611, a strong step towards comprehensive immigration reform. Now that House leaders know that the full Senate won't pass their enforcement-only agenda, they have resorted to closed-door politicking. We must fight to prevent the breach of justice that would result from attaching these enforcement-only bills to must-pass legislation.

Please call and email your Senators today. Now is the time for action.

    Sincerely,

    Marshall

    Marshall Fitz
    Director of Advocacy, AILA

    The enforcement-only provisions are:

     Sections 101 and 102 of the Dangerous Alien Detention Act contained in H.R. 6094, which seek to legitimize the practice of indefinite detention of aliens awaiting removal, despite Supreme Court decisions requiring elimination of this practice;

     Section 201 of the Criminal Alien Removal Act contained in H.R. 6094, which would expand the use of expedited removal proceedings to individuals already in the United States - even individuals who have resided here for years - in ways that would significantly increase the risk of deporting innocent people;

     Sections 301-303 of the Alien Gang Removal Act contained in H.R. 6094, which would grant unfettered discretion to the executive branch to designate "criminal street gangs" and then strip members of such gangs of virtually all rights;

     Section 101 of H.R. 6095, which gives state and local police authority to investigate, arrest, and detain noncitizens for civil violations of immigration status;

Sections 301 and 302 of the Ending Catch and Release Act contained in H.R. 6095, which would limit the power of federal courts to grant injunctive relief in civil immigration proceedings, despite acknowledgement by DOJ that such relief does not interfere with efforts to end the practice of catch-and-release.
